Board of Supervisors Approves Anti-Camping Ordinance on Public and Flood Control District Property

(Santa Ana, CA) – At the November 4 Board meeting, the Orange County Board of Supervisors approved an ordinance to enforce stricter anti-camping laws that would prohibit unpermitted encampments and camping on public property.

This ordinance would prohibit camping and encampments on public and Orange County Flood Control District property, allowing for civil and criminal enforcement measures punishable as a misdemeanor. These enforcement measures can be initiated without warning or prior notice to suspects in violation of the law.

 “Following last year’s Grants Pass decision at the United States Supreme Court, which unshackled local governments’ ability to issue civil and criminal penalties for camping on public land without a permit, many Orange County municipalities have taken action on dangerous encampments in our communities,” said Supervisor Wagner. “With federal and state government giving the green light for more robust enforcement of anti-camping laws, the County of Orange can now ensure that our unincorporated communities are no longer subject to the health and safety concerns associated with these encampments.”

Supervisor Wagner has been a consistent advocate for giving governments local control over their law enforcement, given their unique community circumstances, especially regarding anti-camping ordinances.
